GDPR & DPA

Media Distribution Inc. ("MDI," "we," "our," or "us") is committed to compliance with the General Data Protection Regulation (GDPR) for users in the European Union (EU) and the European Economic Area (EEA). This GDPR Compliance Statement explains how we process personal data in accordance with GDPR and outlines the rights of data subjects under this regulation.

Legal Basis for Processing Personal Data

We process personal data based on consent, contractual necessity, legal obligations, or legitimate business interests. Users provide consent when they explicitly agree to data collection and processing. In cases where processing is required to fulfill contractual obligations, such as providing our software licensing and support services, we rely on contractual necessity. When required to comply with legal or regulatory requirements, we process data under legal obligation. Additionally, in situations where processing supports our legitimate business interests, such as service improvement and security, we ensure that these interests do not override users’ fundamental rights.

Data Collection and Processing

MDI collects and processes personal data to facilitate account registration, manage user accounts, and provide software licensing, training, and ongoing support. Personal data is also collected to process transactions, ensure service functionality and security, and comply with applicable legal obligations. All data processing is conducted in accordance with GDPR principles, ensuring transparency, fairness, and lawfulness.

Data Protection Agreement (DPA)

For business clients handling personal data under GDPR, MDI offers a Data Processing Agreement (DPA) upon request. This agreement defines MDI’s role as a data processor and the client’s role as a data controller. It outlines the scope, nature, and purpose of data processing, specifies the security measures implemented to protect personal data, and details the rights and obligations of both parties to ensure compliance with GDPR.

Data Subject Rights

Under GDPR, users in the EU/EEA have specific rights regarding their personal data. The right to access allows users to request a copy of their personal data held by MDI. If any personal data is incorrect or incomplete, users have the right to request rectification. The right to erasure permits users to request the deletion of their data, provided that legal grounds for retention do not apply. Users may also restrict the processing of their data under certain conditions. The right to data portability enables users to request a structured, machine-readable copy of their data for transfer to another provider. Additionally, users may object to data processing based on legitimate interests or direct marketing and can withdraw previously given consent at any time.

Data Security and Retention

MDI employs industry-standard security measures to protect personal data from unauthorized access, alteration, disclosure, or destruction. These measures include encryption, access controls, and secure data storage practices. Personal data is retained only for as long as necessary to fulfill the purposes outlined in this statement or as required by law. Users can request data deletion if they no longer wish to use our services, subject to legal and contractual obligations.

International Data Transfers

As a company based in the United States, MDI may transfer personal data outside the EU/EEA. To ensure compliance with GDPR, we implement appropriate safeguards such as Standard Contractual Clauses (SCCs) when transferring data internationally. These safeguards ensure that transferred data maintains the same level of protection as required under GDPR regulations.
